During the month of July 25-27, 2022, in El Geneina West Darfur, joint forces of Rapid Support Forces RSF, Sudan Army forces, polices launched mass detention campaign in the areas of “ kingo, Umm Drissi ,Rahad Meriam ,Umm shiqaq, Gereida, Kilkal ,Higlig ,and Baruna” which are north, West of El-Geinana. At least 174 people have been detained, including, teachers, students, and other activists and tribal leaders who have refused to partake in RSF-led reconciliation efforts, brokered by Hemedti.
The decision was by the Governor of West Darfur Khamis Abdullah Abaker, whom had ordered the arrest and detention of these large numbers, acting on the authority of the Emergency Law. and was enforced by Colonel Musa Embolo, deputy leader of the rapid support forces.
The detainees were divided to the two prisons 97 people in the port-Sudan prison, 77 people have been detained in Ardamata prison in west Darfur El –Geinena, without trial. The detainees have been in illegal detention for a period of more than 60 days.
DNMD Monitors carried interviews with families of the victims and established that during the arrests by the combined forces, their properties inclusive of valuable properties such as Gold were looted by the forces. All the men were taken away and that the arrests were forceful and there was use of excessive force, in the sense that the men were beaten and tortured, they were in the torture chamber for a period of one day, and were then taken to the Government of West Darfur. One of the families described the conditions of one of the detainees one Abdallah Matar, during the arrest he had a leg injury and was bedridden. His current condition in prison is deteriorating and is not being subjected to medical care. The families on following up with the detainees confirmed that 97 were detained in Port Sudan Prison and 77 in Adramata prison.
DNMD spoke to Yasir Yahya who was among the detainees, however was released before the detainees were committed to prison. He stated “on 25th July 2022 at approximately 6 am, we were ambushed by a convoy of 36 cars of the Rapid Support Forces, I was at my home at the time, I was approached and beaten, my properties were looted by the Rapid support forces, and I was taken to a big compound together with others totaling to 177 individuals, we were kept from the morning hours until approximately 4pm. We were not fed, and we were instead beaten and tortured, we were prohibited from conducting our usual prayers. After 4pm we were all pushed into a class room of one of the neighboring primary schools.
The classroom space was too small in size, approximately 6 by 7 meters, we were kept in that space for a period of a day, were then dispersed into separate cars of the Rapid support forces, we were transferred to West Darfur State General Secretariat of the Governor’s office. Our names were recorded by the Governor’s office. The Governor falsely announced us as the people in whose possession were unlicensed firearms and Motor Cycles he said . These accusations were used as a reason for our arrests. The governor ordered our numbers to be divided, the youth to be sent to Ardamata Prison, a total of 77 youth, the elderly groups was transferred to Port Sudan Prison, their total number was 97. I was among the 77 youth to be transferred however on being committed to prison, the Prison authority announced that we were four of us whose names were missing from the lists. We were then detained by the Rapid support forces in their detentions for a period of five days. During our five days detentions, we were severally beaten and humiliated basing on us not being part of Arab Shitia tribe. We were released on bail.
A group of defense lawyers in the west Darfur state confirmed to DNMD, that they presented a memorandum of appeal to the court of appeal on 31st August 2022. Appealing the decision of the Governor of West Darfur and no response till date. Darfur Bar Association leaders presented a request to the Chief Justice to enable them to visit the detainees in the Prisons on 10th of September 2022 and there has not been any response yet.
The decision to arrest and detain the above-mentioned individuals is in violation of the Law, since the chairman, sovereignty council decreed to the effect that the emergency law under which they are detained should be lifted, hence their continued detention is illegal and in violation of their right to freedom and liberty. The detainees have not been allowed to come in contact with their legal representatives and family members in further violations of their right to legal representation and personal liberty.
Since 2019, western Darfur had seen systematic and massive human rights violations, including torture, mass displacement, rape, and other forms of sexual violence. Almost 2 million had been driven from their homes. These systematic attacks on human rights were the symptoms of a humanitarian disaster, and were beginning to be seen in the border between Chad, and Sudan and attacks over the border by the Janjaweed came under international laws on conflict.
DNMD condemns the detention of the victims by the Coup Government. And the Governor should take the full responsibility of the outcomes of his decision and the suffering subjected to the victims and their families and the continued security unrest should be accounted for by the parties whom signed the Juba peace agreement 2020.
Called on the Government to either released immediately the detainees or promptly charge them with recognizable offenses before a court of law.
DNMD calls upon all Alliance of human rights in Sudan, our partners, Lawyers and International Organization to put pressure on the responsible parties in order to secure the release of the detainees.
The designated expert on the situation of Human Rights in Sudan, while discharging his mandate, should monitor abuses in Darfur and promptly visit the prisons, notably Ardamata prison West Darfur and port-Sudan prison.
